Contract Duration

The contract period may last between 3 to 12 months, depending on the selected package. Upon completion of the contract term, it must be terminated. Both the artist and OTM Productions reserve the right to exit the contract at any time. 

Neither the client nor OTM Productions can terminate the contract within the prepaid period. However, should the contract need to be terminated prematurely due to misconduct, a refund equivalent to the unfulfilled services  will be issued to the client.

Additional Charges

Any additional studio hours requested by the client will incur an additional charge of £20 per hour. If OTM Productions is required to travel to a client’s location for recording purposes:

- Travel within 30-50 miles will incur an additional £35.

- Travel over 50 miles will incur an additional £65.

Limitation of Liability

OTM Productions accepts no liability for any loss or damage resulting from inaccuracies or incompleteness of information, nor for losses resulting from issues inherent to the dissemination of information over the internet, such as disruptions or interruptions. When using our web forms, we aim to minimize the number of required fields. OTM Productions is not liable for any loss incurred as a result of the use of data, advice, or ideas provided by or on behalf of OTM Productions.

Intellectual Property Rights

All intellectual property rights to content on this website are held by OTM Productions Ltd or by third parties who have either contributed content or from whom OTM Productions has acquired a user license.  

- Copying, dissemination, and any other use of these materials is prohibited unless explicitly permitted in writing by OTM Productions, except as otherwise dictated by mandatory law (such as the right to quote). 

Invoices and Payments

The videographer will issue an invoice to the client prior to commencing the project. Payment must be made within 7 days of receiving the invoice. 

Ownership of Work Product

As part of the services provided, OTM Productions creates work product for the client. This includes, but is not limited to, finished products, drafts, notes, designs, inventions, patents, code, and any other materials created during the course of the project. Upon full payment, all rights to the work product, including intellectual property rights, are transferred to the client.  

- The client will be the sole owner of the work product and may modify, destroy, or sell it at their discretion.  

- OTM Productions is prohibited from registering or attempting to register any intellectual property rights in the work product, unless expressly instructed by the client.

Videographer's Use of Work Product

After transferring ownership, the videographer may not use the work product except as expressly permitted by the client. The client grants permission for OTM Productions to use the work product in portfolios, websites, galleries, and other media solely for showcasing purposes, and not for any commercial use. The client cannot withdraw this permission, even after the contract concludes.

Credit for Work Product  

The client is under no obligation to credit OTM Productions when using the work product, although it is appreciated.

Videographer’s Right to Use Client IP

The client agrees to allow OTM Productions to use their intellectual property (e.g., logos, trademarks) as necessary for the completion of the project. However, no additional intellectual property rights are granted to OTM Productions unless explicitly stated in this contract.

Moral Rights 

OTM Productions waives any moral rights it may have under the Copyright, Designs and Patents Act 1988. This includes the right to be identified as the author of the work and the right to object to how the work is used by the client, unless otherwise specified in this agreement.

Music Filming Policy

- Freestyle Music Videos: OTM Productions will use four camera angles for music video recordings.

- Music Video Sessions: Music video recordings are scheduled in 2-hour slots. The client may choose the filming location.

Amendments and Refund Policy

- Refunds & Cancellations: Refunds or cancellations apply to deposits only.

- Booking Changes: Any changes to the booking date must be made within 7 days of the original booking date.

- Refund Requests: Refund requests must be submitted within 7 days of the original booking date.

- Full Payments: All full payments must be made by the day of filming.

Unsatisfactory Deliverables

If the client is unsatisfied with any deliverable, they are encouraged to contact OTM Productions at contact@otmproduction.org. OTM Productions is committed to resolving any issues and working towards a satisfactory outcome.
